Hawaii state and specifically Governor David Ige is in violation of his oath to the constitution of the United States of America.
Where as the 1st Amendment of the Constitution and the 5th Amendment of the constitution allow us to freely travel and peacefully gather. These are inalienable rights!

Restricting people’s ability to travel, or the right Life, Liberty and the Pursuit of Happiness, is defacto martial law.

Quarantine is for sick people. House arrest is for healthy people. However there is no crime in living one’s life. Therefore this de facto house arrest of Hawaii’s citizens and business is destructive of our freedom, our businesses and our lives.

Hawaiians will no longer stand for the tyranny of this governor.

Reference to the supreme law of our land, the US Constitution:

“The right of a citizen to travel upon the public highways and to transport his property thereon in the ordinary course of life and business is a common right which he has under his right to enjoy life and liberty, to acquire and possess property, and to pursue happiness and safety. It includes the right in so doing to use the ordinary and usual conveyances of the day; and under the existing modes of travel includes the right to drive a horse-drawn carriage or wagon thereon, or to operate an automobile thereon, for the usual and ordinary purposes of life and business. It is not a mere privilege, like the privilege of moving a house in the street, operating a business stand in the street, or transporting persons or property for hire along the street, which a city may permit or prohibit at will.”

It could not be stated more directly or conclusively that citizens of the states have a common law right to travel, without approval or restriction (license), and that this right is protected under the U.S Constitution.

“The right to travel is a part of the liberty of which the citizen cannot be deprived without due process of law under the Fifth Amendment.”

[Kent v. Dulles, 357 U.S. 116, 125 (1958)]

“The right to travel, to go from place to place as the means of transportation permit, is a natural right subject to the rights of others and to reasonable regulation under law. A restraint imposed by the Government of the United States upon this liberty, therefore, must conform with the provision of the Fifth Amendment that ‘No person shall be * * * deprived of * * * liberty * * * without due process of law’.”

Inalienable right refers to rights that cannot be surrendered, sold or transferred to someone else, especially a natural right such as the right to own property. However, these rights can be transferred with the consent of the person possessing those rights.

Other States are having their “stay at home orders” overturned by the courts.

On May 5th Wisconsin Legislators filed a lawsuit against Governor Tony Evers, and the court ruled against the stay at home orders on May 13th 2020.

On May 13th 2020 several Oregon churches filed a lawsuit against the State of Oregon to overturn the “Stay at Home” orders by Governor Kate Brown, on May 14th 2020, the court overturned the stay at home orders, and freed the Oregon people from this tyranny.

Other states are facing similar court action. To this date, not one court has ruled in favor of the state, and instead has ruled in favor of the freedom of the people.

We the people of Hawaii demand our freedom, which is inalienable and therefore non-negotiable.

This petition is being sent to Governor David Ige of Hawaii, and the Hawaii state legislature.
